Move-Away Cases

Sometimes one parent wants to move away with his/her child or children. If that happens, courts are required to conduct an in-depth analysis and consider many factors before making orders about where the children should live (called the “LaMusga factors”), including the health, safety and welfare of the child, the distance of the move, the age of the child, and the child’s relationship with both parents, among other factors.

Often, before a court makes a determination regarding move-aways, the Judge will appoint a mental health professional to conduct what is called a “custody evaluation” and make recommendations before making a final decision.

You should not expect a quick and simple solution to a move-away case, as they often take time to resolve.
